Meeting
October 16, 2003

Hank Langstroth Acting Chairman, Stephan Glicken, Katherine Roth, Stephen Cremer, and Janet Dunlap were the members present. Peter Holden arrived at 7:53 p.m.

7:45 p.m., RDA - Islamic Center of New England. Proposed installation of a waterline & driveway associated  with construction of a new school building at the Islamic Center located off of Chase Drive:

Nezam Khan from the Islamic Center was present.
Joe Fermanian, Engineer from Outback Engineering, Inc. represented the Applicant and submitted the green abutter cards to the Commission.
Joe Fermanian submitted Subsurface Sewage Disposal Plan dated 9/18/03 to the Commission and explained that the scope of the proposed project involves the installation of a waterline and construction of a driveway approximately 100' long that is within the 100' buffer zone to a town protected isolated vegetated wetland. The Buffer Zone disturbance would remain under 5,000 s.f.
Approximately 75' of undisturbed area will remain between the silt fence and the delineated isolated vegetated wetland.
The size of the proposed school building is 66' wide by 96' long, and drainage pipes will be installed in the front of the building. Waterlines will be installed along the proposed driveway. A concrete berm will be built along the side of the driveway closest to the wetland. Oil separators will filtrate the water runoff from the driveway that will subsequently discharge into an underground recharge area.
Perc tests for the proposed project have been completed.
The drainage for the proposed project has been designed for a 25 year storm with emergency capacity.
The proposed school building will have a flat roof design that is pitched from the middle on both sides.
Proposed roof infiltration drains will be located at a minimum of 25' from the leaching fields.
The 6,000-gallon capacity of the proposed septic system is in compliance with the Board of Health regulations. Stephen Cremer asked what plans are proposed for snow removal and for applying ice-melting chemicals.
The Commission requested that the Applicant schedule another meeting with the Commission to discuss the Master Plan for the property and to submit a snow removal plan as well as discussing ice chemical treatment options.
Hank called for a motion to close the hearing.

8:00 p.m., N.O.I. Hearing Continuance, Tony Nakhle - T.N. Real Estate & Dev. Co. Proposed Construction of a driveway and site preparation associated with the construction of a dwelling on property currently owned by the Elizabeth Peabody House/Camp Gannett. DEP # SE-280-443:

The Applicant was not present at the hearing.
The Commission stated that another meeting should be arranged with representatives from
The Elizabeth Peabody House to discuss the permanent protection of the remaining Camp Gannett land.
The Commission discussed the possibility of purchasing the property development rights.
Hank called for a motion to close the hearing.

8:15 p.m., N.O.I. Hearing Continuance, DEP# SE-280-431, Peter Dangelo, 140 Maskwonicut Street. Driveway site preparation:

Peter Dangelo appeared before the Commission and explained that he owns a 3-acre parcel of land that is locatedwithin a major wetland area. The proposed project is for a driveway site preparation for a proposed new house construction that would be built just outside the 100' Buffer Zone.

The proposed installation of the new septic system is 125' from the delineated wetland line.
The Commission discussed the possibility of placing a restriction on the property in exchange for the Applicant gaining access to a useable section of the parcel.
Hank requested that Peter Dangelo submit a concept plan showing access to the back highland of the property.
Hank called for a motion to continue the hearing until November 6, 2003.

8:30 p.m., N.O.I. Hearing Continuance, DEP# SE-280-442. Jay Rosenbaum, Lakefront, 61 Massapoag Ave., Modular Block Retaining Wall:
Forrest Emery represented the Applicant and explained to the Commission that he is awaiting comments from the Massachusetts Natural Heritage and Endangered Species Program regarding the issue of the rare wetland species habitat on the site.
He referenced a letter that had been written by the NHESP to Mr. Stephen Woogmaster, 80 Massapoag Ave.
Mr. Woogmaster had previously filed a similar project with the Commission and NHESP determined that the project would not adversely affect the actual habitat of the state protected rare wildlife species.
Forrest presented a revised plan prepared by Phoenix Environmental Group dated 10/3/03 to the Commission entitled, Stabilization of Beach and Recreation Area at 61 Massapoag Ave., Sharon, MA.
Forrest informed the Commission that Mr. Rosenbaum hired a professional land surveyor to stake out the property and based on his findings, the buildable upland area, exclusive of the Lake Massapoag right of way, is 8 to 10 feet wide by 20 feet long.
The proposed drainage for the project consists of a 2% slope with clean, granular sandy fill, with the direction of the water flow traveling towards the lake.
The exposed height of the proposed SRW Wall is 18 to 48 inches maximum.
The proposed project is above the mean high water line of Lake Massapoag.
Greg visited the site and determined that it would be necessary to preserve some of the existing buffer zone vegetation on the left-hand side of the property.
The Applicant proposes to install a 4' post and rail fence up against the right of way.
Forrest stated that most of the property currently utilized by the property owners in that section of Massapoag Avenue is located within the Massapoag Avenue right of way.
The Commission granted permission to the Applicant to remove a partially diseased 16' red maple tree located on the abutting property.
